CRIMINAL AND PENAL LAW

Criminal law prohibits acts that go against the fundamental values of our society, such as murder and theft. In Canada, most criminal offenses (“crimes”) and their consequences (“penalties”) are provided for in the Criminal Code. 

A defendant is innocent until proven guilty.

Although trials can sometimes be long, all defendants have the right to a trial. Indeed, an accused is “presumed innocent” until found guilty by the court.

This “presumption of innocence” means that the accused is officially innocent until proven guilty in court. Why? Because the consequences of a conviction are very serious.

Public business law, or public economic law, includes all the branches of law relating to public intervention in economic activities. Contrary to what its name might suggest, all the components of public business law do not come under public law. Commercial law, le competition law  or even the substantive law of the European Union have an essential place in the exercise of public business law. The latter is therefore more of a multidisciplinary subject than an independent branch of law.
